Terms of Use
This is an English translation. If it differs from the Portuguese version, the Portuguese version prevails.
In short
- These Terms apply to the inkecode.com website and to INK & CODE apps. The first one is Ferramentas Escoteiras, coming soon to Google Play.
- The app is free. You can install and use it. You may not sell, distribute or modify the app.
- The compass, GPS and map help, but they can be wrong. Bring a printed map and a traditional compass, and follow your group's safety rules.
- Children and adolescents use the app with permission from their parents or guardians. Outdoors, always with a responsible adult.
- Maps come from OpenStreetMap. The map data is © OpenStreetMap contributors.
- We do not receive the data you create in the app. It stays on your device (and in your Google account backup, if backup is turned on). See the Privacy Policy.
- Your consumer rights still apply. Questions: support@inkecode.com.
1. Who we are and what these Terms cover
These Terms of Use are provided by INK & CODE LTDA, CNPJ (Brazilian company ID) 59.886.586/0001-86, based in Curitiba – PR, Brazil. In this text, “INK & CODE”, “we” and “our” refer to it. “You” means anyone who uses the website or the apps.
These Terms apply to:
- the website inkecode.com;
- the apps that INK & CODE publishes, or may publish, on Google Play under the developer name “Ink & Code”. The first one is Ferramentas Escoteiras.
If an app has its own rules, they will appear on its page or inside the app and will apply together with these Terms.
2. Acceptance
By installing and using an app, you agree to these Terms. If you do not agree, do not use the apps. The rules about the website serve as information for people who visit it.
If you are under 18, use the apps with the permission of your parent or legal guardian. See the section Children and adolescents.
Please also read the Privacy Policy. It explains how we handle personal data.
3. The inkecode.com website
The website presents the company, our apps and the services we offer. It has no sign-up, login, forms or sales.
The information on the website is general and may change. If we find an error, we will correct it.
Custom projects (apps, web systems, IT consulting, support and maintenance) are contracted separately, under their own proposal or contract. Sending an email does not create a contract. When there is a contract, it prevails over these Terms on the matters it covers.
The website may link to third-party websites. Those websites follow their own rules. We do not control their content.
The website is hosted on GitHub Pages, a GitHub service. See the Privacy Policy to learn what GitHub records.
4. The Ferramentas Escoteiras app
Ferramentas Escoteiras is a field kit for scouts, scout leaders and hikers. It brings together tools such as a compass, Morse code, trail signs, map and trails, timer, whistle, phonetic alphabet and Caesar cipher.
- The app is for Android. Its interface is in Portuguese.
- The app will be officially distributed through Google Play. Download it only from there.
- The app does not ask for sign-up or an account.
- Today, the app is free, has no ads and has no in-app purchases. If that changes, the conditions will be shown clearly before any charge.
- Some features ask for Android permissions: location (compass and map) and camera (turning on the flashlight in Morse code, without taking a photo, and taking the photo of a point through the device's camera app). You can deny them. In that case, those features are limited, and the rest of the app keeps working.
- The data you create in the app (trails, points, recorded routes, photos and settings) stays on your device and, if Android backup is turned on, in your own Google account. INK & CODE does not receive this data and does not keep a copy of it.
5. Free license to use
The app is licensed, not sold. INK & CODE grants you a free, personal, non-exclusive and non-transferable license to install and use the app on devices that you own or control.
You may use the app for personal and educational purposes and in scouting activities, including with your group.
The license does not allow you to:
- sell, rent, lend, sublicense or distribute the app or copies of it;
- modify the app, create derivative versions, decompile it or reverse engineer it, except where the law allows;
- remove or hide copyright, trademark or license notices, including the OpenStreetMap attribution.
The app includes third-party components, such as open-source libraries. They follow their own licenses. These Terms do not reduce the rights that those licenses give you.
The license ends when you uninstall the app. It may also end if you seriously breach these Terms.
6. Rules of use
By using the website and the apps, you agree to:
- respect the law and the rights of other people;
- not use the app to watch or track another person without their consent;
- ask for permission before photographing people, especially children and adolescents;
- respect private property, protected areas and the rules of parks and reserves;
- not try to overload, bypass or harm the website, the app or the map servers, for example by bulk-downloading map areas;
- not use the names “Ink & Code” and “Ferramentas Escoteiras” to pretend to be us.
7. Safety in outdoor activities
The app is a support tool. It does not replace a printed map, a traditional compass, training, planning or common sense. Never rely only on your phone to find your way.
Compass limits
- The app's compass uses the phone's sensors. Metal, magnets, cases with magnets, vehicles, electronic devices and power lines can throw off the reading.
- The sensors may need calibration. Accuracy varies from one device to another.
- If you use the magnetic declination setting, check the correct value for your region. A wrong value leads to wrong bearings.
GPS and map limits
- Your position depends on the GPS signal and on the device. Dense forest, valleys, canyons, buildings and bad weather reduce accuracy. If you allow only approximate location, accuracy will be lower.
- The app uses location only while the compass or map screen is open. It does not use location in the background.
- Route recording works only while the map screen is open. It stops when you leave the screen, switch apps, turn the screen off or open the camera to photograph a point. After that, your position on the compass and on the map may stop updating. Leave the compass or map screen and open it again before trusting the position shown.
- The map needs internet to download areas. Without internet, an area may not appear, even if you have seen it before.
- Distance, azimuth and scout paces between points are estimated calculations. The paces use the value you have configured.
- A trail that appears on the map may no longer exist, may be closed, may be private or may be dangerous.
Before and during the activity
- Bring a printed map and a traditional compass, and know how to use them.
- Start with your phone fully charged and, if you can, bring a portable charger. GPS and the flashlight use up battery.
- Follow the safety rules of your scout group and the guidance of scout leaders and guardians.
- Tell someone your route and the time you expect to be back.
- Children and adolescents must always be supervised by a responsible adult in outdoor activities.
- Do not keep looking at the screen on dangerous stretches, near water, near cliffs or near roads with traffic.
- Do not rely only on the Morse code flashlight, the whistle or any other feature of the app to call for help. They may not work on every device and may not be seen or heard from far away.
- In an emergency, call 193 (Corpo de Bombeiros, the fire department) or 192 (SAMU, the mobile emergency medical service).
8. Maps and OpenStreetMap
The app's map uses data from OpenStreetMap. The map data is © OpenStreetMap contributors and is available under the Open Database License (ODbL). See the copyright and license details at openstreetmap.org/copyright.
The map images are downloaded from the servers of the OpenStreetMap Foundation. Use of these servers follows the OSMF tile usage policy.
- OpenStreetMap is made by volunteers. The data may be incomplete, out of date or wrong.
- We do not control these servers. The service may be slow, go offline, or limit or block access, without notice.
- We may change the map provider in the future. If that happens, we will update these Terms and the Privacy Policy.
To learn which data reaches the map servers when you use the map, see the app section of the Privacy Policy.
9. Third-party services
The website and the app work with services from other companies. Each one follows its own terms and policies. We do not control these services, and they may change or stop without notice from us.
- Google Play: to download and update the app. It follows the Google Play Terms of Service.
- Google Play services: works out the device's location for the compass and the map and may provide the emoji font. The app does not send data to Google on its own, but Google Play services may process location and network signals and service usage data under Google's Privacy Policy.
- Android backup: if backup is turned on on your device (Android 6.0 or newer), Android may copy the app's data to your own Google account, under Google's rules.
- Camera app: the photo of a point is taken by your device's camera app. Depending on its settings, that app may record the location in the photo or keep a copy in the gallery.
- Other apps you choose: when you export a trail or copy a text, the app only copies the content to the clipboard. Where you paste that content is your choice and follows the rules of the app you choose.
- OpenStreetMap Foundation: provides the map images. See the section Maps and OpenStreetMap.
- GitHub: hosts the inkecode.com website.
10. Intellectual property
The apps' software, design, texts, illustrations and icons created by us belong to INK & CODE and are protected by copyright and software laws. Traditional scouting content, such as the Scout Promise, appears in the app for educational purposes and continues to belong to whoever holds rights over it. Ferramentas Escoteiras is an independent app: it is not an official app of the União dos Escoteiros do Brasil (Scouts of Brazil) or of the World Organization of the Scout Movement.
The following are not ours and follow their own licenses:
- the map data, © OpenStreetMap contributors, under the ODbL;
- the open-source libraries included in the apps;
- the website fonts, used under the SIL Open Font License.
The content you create in the app, such as trail names, point descriptions and photos, is yours. It stays on your device (or in your Google account backup), and we have no access to it.
These Terms give you no right over our trademarks, other than the use of the app described in the section Free license to use.
11. Children and adolescents
Ferramentas Escoteiras may be used by scouts of all ages, including children and adolescents.
- Children and adolescents must use the app with the permission and under the responsibility of their parents or legal guardians. For people under 16, the parents or guardians accept these Terms on their behalf. Adolescents aged 16 and 17 accept together with their parents or guardians. Guardians keep an eye on use.
- In outdoor activities, children and adolescents must always be supervised by a responsible adult.
- The app has no account, chat, ads or profiles. The data that the child or adolescent creates stays on the device (or in the backup of the device's Google account) and is not sent to us.
For parents and guardians:
- keep an eye on the use of the app, especially the map and the camera;
- in Android settings, you can see and change the app's location and camera permissions;
- you can use Android and Google Play parental controls;
- to delete the app's data, see the app section of the Privacy Policy.
The app's age rating will appear on its Google Play page once the app is published.
To report a violation of the rights of children or adolescents connected to the website or to our apps, write to privacy@inkecode.com. The channel is free of charge.
12. Privacy
How we handle personal data is described in the Privacy Policy, a document separate from these Terms. Among other points, it explains what the app keeps on the device, what leaves the device and how to delete the data.
For privacy and data protection matters, write to privacy@inkecode.com.
13. Availability, changes and discontinuation
- We work to keep the website and the apps running well, but they may have faults or be offline for some time.
- We may update, change, suspend or discontinue the website, an app or a feature, for example for technical or legal reasons or because Google Play requires it.
- When reasonable, we will give advance notice on the website or on the app's page on Google Play.
- Some updates may be necessary for the app to keep working. Old versions may stop working on new versions of Android or with the map servers.
- If an app is removed from the store, the installed copy may keep working, but there is no guarantee of updates or that the map will remain available.
- The data you create in the app stays on your device and, if Android backup is turned on, also in your own Google account. INK & CODE does not receive this data and has no copy of it, so we cannot recover it. If the data is important, write down or export the trail. The export produces a text with the trail's points, but it does not include the recorded route or the photos. Do not count on Android backup to keep this data: it does not exist on Android 5, it has a size limit, and it may stop without notice when the app goes over that limit.
14. Liability
Nothing in these Terms excludes or reduces rights that the law guarantees you, including those under the Código de Defesa do Consumidor (Consumer Protection Code, Law No. 8.078/1990).
INK & CODE is liable for defects in the app as the law provides. It is not liable when the damage comes exclusively from:
- decisions made only on the basis of the app's readings, without the precautions in the section Safety in outdoor activities;
- limits of the device and the environment, such as magnetic interference, lack of GPS signal, low battery or lack of internet;
- errors in OpenStreetMap data, which is maintained by volunteers and not by us;
- third-party services, which follow their own terms;
- use that goes against these Terms or the law;
- copies of the app that were modified or obtained outside Google Play;
- loss of data kept on your device, when the loss is not caused by a defect in the app.
When the law holds us liable, we will be liable within the limits it sets.
15. Changes to these Terms
- We may change these Terms to keep up with changes in the apps, the website, the law or third-party services.
- The new version will be published on this page, with a date and a version number.
- If the change is important, we will give prominent notice on the website and, when possible, in the app or on its page on Google Play, before it takes effect.
- Changes apply only going forward and never take away rights that the law guarantees you.
- If you do not agree with the new version, you can stop using and uninstall the app at any time, at no cost.
16. Governing law and forum
These Terms are governed by the laws of Brazil.
If you have a problem, talk to us first at support@inkecode.com. We will try to solve it quickly and in a friendly way. This does not prevent you from going to consumer protection bodies, such as Procon (the state consumer protection agency), or to the courts.
The courts of the judicial district (comarca) of Curitiba – PR are chosen as the forum, without prejudice to the consumer's right to file a lawsuit in the courts of their own domicile (art. 101, I, of the Código de Defesa do Consumidor). If a lawsuit is brought against you, the consumer, it will be filed in the courts of your domicile.
17. General provisions
- These Terms take effect on November 7, 2026.
- These Terms form the agreement between you and INK & CODE on the use of the website and the apps. The Privacy Policy explains how we handle personal data. Custom project contracts are separate.
- If any part of these Terms is found to be invalid, the rest remains in force.
- If we fail to enforce a rule in one case, that does not mean we have given it up.
- These Terms are also available in Portuguese, and this English text is a translation. If there is a difference, the Portuguese version prevails.
